Terms & Conditions
- between the Hirer/client and Belle Vie Campers. These terms together with the Belle Vie Campers reservation and the hire agreement (given to the Hirer on collection of a hired item will combine to form the entire hire contract.
- These Terms & Conditions of contract are governed in all respects by English Law and the Parties submit to the jurisdiction of the English Courts
- ‘Belle Vie Campers’ means the sole trading enterprise of JP Hanberry under the trade mark Belle Vie Campers and registered in France under SIRET 528 211 881 (210 rue des Gourbets, 40600 Biscarrosse) and UK (18a Lambourn Road, London SW4 0LY)
- ‘Hirer’ means the person or persons nominated as the hirer under the heading ‘Hire Details’ on the Hire Agreement and any person whose credit card is presented in payment of Belle Vie Campers charges.
- Any changes to this agreement must be in writing and must be signed by suitably authorised signatories on behalf of Belle Vie Campers and the Hirer. This Agreement constitutes the entire agreement of the parties and there are no other oral undertakings, warranties or agreements between the parties relating to the subject matter of this Agreement. In the event of any discrepancy between these Terms & Conditions and any other Belle Vie Campers literature, the provisions of these Terms and Conditions apply.
- Belle Vie Campers reserves the right to vary rates and conditions at any time and choose the right to deny potential hirers should they consider the hirer and guests to be unsuitable for the type of experience Belle Vie Camper provides.
- The vehicles and its equipment and hire equipment remains the property of Belle Vie Campers at all times.
- All payments are made to or by Belle Vie Campers shall be made in euros or pounds sterling if hirer is a UK resident. The rate for any euro to sterling exchange conversion provided by the daily tourist rate provided by ‘thisismoney.co.uk’. Any additional hire items and transfers to be paid in euros in cash or cheque at the time of booking. Payment is taken via credit/debit cards accepted by PayPal or direct bank transfer to either our UK or France bank account. The hirer is responsible for any payment/bank charges. PayPal typical charge 2.9%. Belle Vie Campers reserve the right to refuse hire to any person without explanation or prior warning
- The Hirer acknowledges that Belle Vie Campers retains title to items of hire and that the Hirer possesses the goods as a mere bailee only. The Hirer does not have any right to pledge Belle Vie Campers credit in connection with the items of hire and agrees not to do so, and shall not agree, attempt, offer or purport to sell, assign, sublet, lend, pledge, mortgage, let on hire, or otherwise part with or attempt to part with the personal possession of or otherwise deal with the items of hire.
- Reservations can only be secured when Belle Vie Campers has received a reservation form and a reservation deposit payment of 30% of the camper hire. The Booking Deposit is not refundable and shall be deducted from the hire charge. The final balance must be paid no less than 10 working days prior to the start of the Hire unless agreed otherwise. Failing this the booking will no longer be secure.
- Late bookings are at the discretion of Belle Vie Campers.When a booking is taken within 28 working days of departure, the balance shall be paid in full with the return of the Booking Form.
- Cancellations must be in writing and are charged as follows: The booking deposit is not refundable.Cancellation between 6 – 4 weeks before start of Hire: 50% of total hire charge.Cancellation between 4 weeks – no show: 100% of total hire charge. Belle Vie Campers reserves the right to cancel the Hire if at the commencement of the Hire the Driver’s licence(s) is invalid or is not in accordance with the conditions set out above. In these circumstances the total hire charge will be forfeited.
- Personal Travel Insurance:This is your responsibility and we do not cover personal items, belongings or personal injury in the event of an accident.
- Availability: Every effort is made to ensure that the hire vehicle reserved is available. If due to circumstances beyond Belle Vie Holiday Adventures ’s control the reserved hire vehicle is not available, Belle Vie Campers reserve the right to offer a suitable alternative. In that event, the Hirer shall not be liable for any increased rental or other charges save for any addition running costs pertaining to the substitute items of hire. Such substitution shall not entitle the Hirer to any refund and does not constitute a breach of this Agreement. If an alternative is not available the liability of Belle Vie Campers will be limited to the refund of any monies paid by the Hirer and the Hirer will have no further claim of any kind against Belle Vie Campers
- Short term breaks are permitted and subject to change at the discretion of Belle Vie Campers in order to co-ordinate reservations for peak periods and national and public holidays. The split-screens are not permitted for short-term hire with out prior approval of the vehicle owner of which Belle Vie Campers may act as an agent.
- Liabilities:The Hirer shall be responsible for all costs and fines incurred because of offences against the Road Traffic Acts and /or regulations including speeding and parking tickets. The Hirer shall ensure that the driver and all passengers required by law to do so shall, when the hire vehicle is being driven, wear the seat belts provided. In the case of an accident, loss or damage arising out of the use of the hire vehicle (including theft of the hire vehicle), the Hirer must notify Belle Vie Campers by phone within 2 hours of the event and provide in writing the names and addresses of all third parties and witnesses involved report the event to the police immediately (and obtain crime number where relevant) not admit any liability to third parties or accept any offer of settlement or other offer. The Hirer will assist Belle Vie Campers in handling any claim arising from any event, including providing all relevant information and attending Court to give evidence if required. The Hirer shall immediately send to Belle Vie Campers any Writ of Summons or Summons or other document relating to any claim or proceedings arising out of any accident to Belle Vie Campers
- Terminating the Agreement: The Hirer acknowledges that Belle Vie Campers may terminate the Agreement and repossess items of hire at any time without reference to the Hirer if: The Hirer breaches the Agreement in any way; The hire vehicle has been obtained through fraud or misrepresentation; The hire vehicle appears to have been abandoned; The hire vehicle is not returned on the agreed return date or Belle Vie Campers reasonably believes that the hire vehicle will not be returned on the agreed return date; Belle Vie Campers reasonably considers that the safety of the passengers and / or the condition of the hire vehicle is endangered; The Hirer will have no right to any refund or the Security Deposit in the event of any termination or repossession; Release and Indemnity of Belle Vie Campers; Subject to its obligation to deliver the items of hire or an appropriate substitute items of hire, the Hirer releases Belle Vie Campers, its employees and agents, from any liability for any loss or damage incurred by the Hirer by reason of this Agreement, including but not limited to:
- Any loss or damage caused by breakdown, mechanical defect or the items of hire being unsuitable for any purpose;
- Any loss or damage to any property left in or on the items of hire, in any service vehicle or on any Belle Vie Campers premises or recovered or handled by Belle Vie Campers. Subject to any insurance arrangements agreed with Belle Vie Campers, the Hirer hereby indemnifies and shall keep indemnified Belle Vie Campers, its employees and agents against any claims, demands and expenses (including legal costs) incurred or sustained by them or any of them by reason of the Hirers use and/or possession of the items of hire.
- The Hirer is liable for ensuring, that the named Driver(s) complies with the following obligations. He or she;
- Shall not be driven other than in a cautious, prudent and normal manner or used in a manner which could cause harm
- Shall not lend or hire the vehicle to a third party.
- Shall not tow any trailer or vehicle with the hire vehicle unless agreed so otherwise
- Shall not carry more passengers than the permitted capacity of the hire vehicle
- Shall not use the hire vehicle for carriage of passengers or goods for hire or reward.
- Shall not move the hire vehicle without the written consent of Belle Vie Campers out of the France or Basque Country of Spain.
- Shall not use the hire vehicle for or in conjunction with any race, competition, trial or for hire or reward, or on non-metalled or sealed roads, or park or drive on any beach.
- Shall not allow the vehicle to be damaged by submersion or contact with salt water
- Shall restrict hire vehicle movements in certain areas due to adverse road or weather conditions, or any other reasonable cause.
- Shall be responsible for the costs of recovery for a hire vehicle that has become bogged.
- Shall not carry volatile liquids or gases (other than the LPG canisters provided with the hire vehicle), explosives or other corrosive
- or flammable materials.
- Shall not permit smoking in the hire vehicle.
- Undertakes to keep the hire vehicle securely locked at all times when unattended and to refrain from any action or omission which may prejudice Belle Vie Campers rights to the hire vehicle.
- Shall not leave the ignition key in the items of hire while unoccupied
- Shall not leave unoccupied without the steering wheel security lock applied, and any valuables out of sight.
- Shall not make any alterations or additions to the items of hire without the prior written consent of Belle Vie Campers
- Shall not allow the hired vehicle to be driven by anyone other than those named in the Hire Agreement and authorised by Belle Vie Campers.
- Shall ensure that the Driver is fit and capable at all times.
- Shall ensure that the Driver does not drive the vehicle when unfit through drink or drugs or with blood alcohol concentration above the limit prescribed for the time being by road traffic legislation.
- Shall ensure that any change of circumstances or the Hirer and/or named driver(s) (e.g. address, driving convictions) are notified to Belle Vie Campers within 24 hours of any such change.
- The Hirer warrants that all information supplied to Belle Vie Campers in connection with this agreement is true.
- Insurance:The Hirer is provided with fully comprehensive/all risk insurance for the duration of the Hire period only. Hirers should note that they are not covered by insurance should the hire vehicle not be returned to Belle Vie Holiday Adventures at the stipulated date. The Hirer is insured for damage to the hire vehicle and property of a third party. In the event of any damage to the vehicle the Hirer will be responsible for the first 1000 euros. The following are not covered by Belle Vie Campers’ insurance: Any personal injury as a result from an accident, personal travel insurance is required that covers you to use a hired vehicle; Personal effects within or from the vehicle (do obtain your own travel insurance for your personal valuables and belongings; Windscreen & tyre damage; Loss/damage/theft to the radio, stereo equipment, aerials, bike carrier, roof rack accessories.; Interior damage, including burns, to seats, flooring and living or cooking equipment, window blinds or curtains, elevating roof, any equipment on hire; any consequential expenses or additional costs incurred in hiring alternative vehicles, late arrival, missed ferries, accommodation, travel expenses or any third party claims in connection with a breakdown or accident. The Hirer shall be liable to pay the full cost of repair of any damage, which the hire vehicle may suffer as the result of the willful or negligent action of the Hirer.
- Any hire vehicle hired may only be driven by the Hirer and/or agreed additional Drivers who have been accepted by Belle Vie Campers and their Insurance Company. All named Drivers must be over 25 and under 70 years of age and have held a full EU/UK license or other approved equivalent for at least two years or other national licence accompanies with a valid international drivers permit. The price quoted on the reservation form includes insurance cover for one named driver with a license. Any additional surcharges due to, for example: driver’s age,history of endorsements within the last five years, history of accidents, physical/mental defects, refused motor insurance record, motor convictions; additional drivers will be advised by Belle Vie Campers on receipt of the completed during booking, and any additional costs will be payable in advance with the final balance.
- Limited Distance: There is a limited distance of 875 kilometres per week with additional kilometers charged at 0.30 cent per kilometre. There is a recommended distance of 175 kilometres in one journey cruising at 80-90 km/hr with a minimum engine ‘cool down’ period of 2 hours. We strongly advice against driving more than 100 kilomteres during he heat of the day between 1pm and 4pm when the weather is hot. This is because the engines are air cooled and rely on the air to cool the oil temperature. Please contact us if you have any questions about this and if you plan to do more or want to know distances of your route.
- Identification Documents: The following must be supplied prior to commencement of a reservation in order to validate insurance and the hire agreement. Valid driving licence: In the case of UK paper licence, photocopy of all sections of the licence. Non-EU/UK/Swiss licence holders must possess a valid International Driving Permit, available online. Copy of travel insurance policy; Valid passport/ identification card
- Hire Deposit: There is a 1000 euro refundable hire deposit that covers the insurance excess, security, damage and cleaning deposit. It is taken separately from the balancing payment and must be paid through PayPal one day prior the reservation date. If the hire vehicle is returned in good condition (subject to inspection) clean, whole and undamaged, the hire deposit will be returned to the Hirer within one week. Should the condition of the hire item be otherwise, then repairs, replacements, refueling, or cleaning costs will be charged against the hire deposit with a time rate of 15€/hour for any work that is required. Should the repairs, replacements or cleaning expenses amount to less than 900 euros to rectify, the deposit will be cashed and the balance shall be returned to the Hirer within 45 days or as agreed.
- Breakdown: In the event of a breakdown or an accident a breakdown service is at disposal of the Hirer, details of which will be given out at the start of the Hire period and which are in the Hire items of hire. The Hirer acknowledges that although Belle Vie Campers has made every effort to ensure that the vehicle is kept regularly serviced and is supplied in full working order, breakdowns can occur from time to time. Belle Vie Campers is not responsible for any consequential expenses or additional costs incurred in hiring alternative vehicles, late arrival, missed ferries, accommodation, travel expenses or any third party claims in connection with a breakdown or accident. The Hirer will be charged for anything that is deemed by Belle Vie Campers to be a driver-induced error (e.g. running out of fuel, wrong type of fuel, locking keys inside the vehicle, losing keys or driving with un-due consideration for vehicle and its age.) In the event of the breakdown service being unable to repair the vehicle, Belle Vie Camers will endeavor to supply a replacement vehicle, subject to availability and location of the Hirer at the time of breakdown, but can not guarantee a replacement
- Collection and Return: Collections will normally be after 3pm and returned before 11 am on the relevant days by arrangement with Belle Vie Campers. If the hire vehicle is returned late (i.e. outside the agreed times), the Hirer will be surcharged at the rate of 50 euros per hour or part thereof together with any additional costs incurred by Belle Vie Campers (e.g. compensation to the next Hirer.) If you find you are unable to collect the hire vehicle at the agreed times, please contact us as soon as possible and we will try to be available outside these hours. No refund is given for an early return of the hire vehicle for any reason, (e.g. accident, weather or theft). Where hire vehicles have been arranged to be delivered to / collected from the Hirer, times and details shall be previously arranged and agreed by Belle Vie Campers and the Hirer. The Hirer shall be given the opportunity to check the hire vehicle for defects and shall notify Belle Vie Campers of any obvious defects before commencing the Hire. The Hirer is advised to check the hire vehicle thoroughly before signing the items of hire Hire Agreement. The breakdown or malfunction of equipment after the hire vehicle has left the premises will not be accepted as reason to abort or cancel the Hire Agreement, and any such fault will be rectified as soon as possible. Any accidental damage caused to a hire vehicle once covered by the Hire Agreement but still on Belle Vie Campers premises shall be deemed as the Hirer’s responsibility. The Hirer is responsible for returning the hire vehicle with a full tank of unleaded fuel and ensuring that it is as clean as at the point of Hire. Upon return, Belle Vie Campers representative will check the hire vehicle for damage, cleanliness, a full tank of fuel, condition of the tyres, windscreen, bumpers, roof lights, mirrors, doors and internal habitation equipment.
- Cleaning: Belle Vie Campers will make the following charges for additional cleaning: 50 euros for the cleaning of stained, dirty, un-tidy interior. 50 euros for a very dirty interior or exterior. Please note that the hire vehicles have a fragile paint finish. They must NEVER be taken through a car wash, or washed using a pressure wash. Should this be ignored, damage to paintwork and the resulting damage repair amount quoted by a specialist vehicle expert shall be passed on in full to the Hirer. 100 euros if the no smoking clause has been ignored. Please consider that the next customer may be collecting the hire vehicle within hours of your return time.
- Pets: The Hirer will not allow any animals to be carried in the hired vehicle unless agreed in writing by Belle Vie Campers before travel. The Hirer acknowledges that any damage, repair costs or extra valeting costs caused by a pet in the items of hire must be paid for in full.
- Fuel, oil, water, tyres and gas: Belle Vie Campers warrants that hire vehicles are roadworthy, licensed and taxed and that all appropriate checks are carried out by Belle Vie Campers before commencement of the Hire period. The hire vehicles use ordinary unleaded petrol or the green ‘Essence sans plomb 95/98’ in France. The Hirer will be liable if the incorrect fuel type is used. We can refuel the camper at the end of your hire if you have not had time and deduct from your hire deposit. The Hirer is responsible for the regular checking of oil. The Hirer shall take reasonable steps to properly maintain the vehicle hire, including oil checks and batteries. The Hirer acknowledges that Belle Vie Campers will reimburse expenditure up to 50 euros reasonably incurred in rectifying any mechanical failure to the drive train and engine of the vehicle (not including the water system, refrigerator, heating, audio and DVD equipment) provided that: Work has been undertaken with the prior consent of Belle Vie Campers; Any claim is accompanied by the relevant receipts; The damage is not due to any fault or breach of this Agreement by the Hirer; The Hirer agrees that the tyres on the items of hire are visibly sound and within legal limits. Any damage or repair to tyres is the responsibility of the Hirer, unless it can be shown that damage is due to invisible defects in the manufacture of the tyre, which are covered by a manufacturer’s warranty, in which case Belle Vie Campers may reimburse the Hirer. For any reimbursement the Hirer must: return the defective tyre to Belle Vie Campers for inspection and return produce appropriate receipts
